Adam joined Thomas Gold Pettingill after first gaining a wealth of experience in civil litigation at the Crown Law Office of the Ministry of the Attorney General. Adam’s practice at the firm includes defending complex insurance matters involving occupiers’ liability, tavern liability, sports liability, product liability, professional negligence, and motor vehicle insurance claims. Adam also regularly represents insurers in first-party insurance claims under CGL and homeowners’ policies. Adam has represented clients before the Superior Court and the Divisional Court of Canada.
A selection of Adam’s recent work includes:
National Steel Car Limited v Arcelor Mittal Dofasco, 2022 ONSC 6742: Successfully resisted a complex motion for a mandatory injunction to compel the City to undertake expensive (and duplicative) remediation of a water channel, where there were serious issues of liability and causation in dispute.
Zgrablic v. State Farm Fire and Casualty Company, 2019 ONSC 1968. Successfully upheld an arbitration award at Divisional Court in a first party property loss claim.
Panarites v. Andrew Grant Design Group et. al., 2018 ONSC 7420. Successfully allowed for a defendant to issue a Third Party Claim outside of the limitation period for reasons of discoverability.
