The claimant sought SABS death benefits following a March 2022 accident that resulted in the death of his 21-year-old brother. The key issue at the LAT hearing was whether the claimant was considered a dependant of his brother at the time of the accident, pursuant to s. 3(7)(b) of the SABS. The claimant submitted that as a disabled person he suffered emotional loss and lost financial support that he reasonably expected to receive from his brother in the future. The LAT found that there was a lack of evidence to support the claimant’s claimed circumstances, and the claimant failed to demonstrate that he was principally dependent on his brother for financial support or care in accordance with the SABS. The application was dismissed. The claimant was not entitled to a death benefit.
